The Kansas Supreme Court has upheld the murder sentence of Benjamin
Appleby. KMBZ's Bill Grady reports though that a second conviction
has been reversed. Appleby was convicted of killing Leawood teenager
Ali Kemp in 2006, he was given 50 years in prison. Today, the State's
high court reversed a second conviction and 19 year sentence for
attempted rape, claiming it would be unconstitutional to convict
Appleby twice for the same offense. Ali Kemp was attacked at a
Leawood pool house in the summer of 2002 . Todays ruling came on an
appeal from the defendant. He asked that both convictions set aside,
claiming when arrested, Appleby's requests for an attorney were
ignored.
